Terms & Conditions

By accessing this website, placing an order, purchasing goods or services from Nanodog, or accepting delivery of any goods, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.

Customers are encouraged to carefully review the product descriptions, specifications, compatibility information and any other relevant information before completing a purchase. If you are uncertain about the suitability of a product, please contact Nanodog before placing your order.

Nanodog delivers orders throughout South Africa. From time to time, Nanodog may offer free delivery promotions at its sole discretion.

All delivery estimates are subject to supplier stock availability. Should a product become unavailable after an order has been placed, a Nanodog representative will contact the customer as soon as reasonably possible to discuss the available options, which may include waiting for new stock, selecting an alternative product, or receiving a refund where applicable.

Customers are responsible for ensuring that the delivery address and contact details provided are complete and accurate. Where an incorrect or incomplete delivery address results in additional transport, storage or redelivery costs, Nanodog reserves the right to recover such reasonable additional costs from the customer.

Orders are shipped using Nanodog's preferred courier partners unless otherwise agreed. Should a customer request that a different courier or transport provider be used, all associated transport costs and risks shall pass to the customer once the goods have been handed to the nominated courier or carrier.

Nanodog will exercise reasonable care when packaging and dispatching all orders. Risk in the goods passes to the customer only upon delivery to the delivery address specified in the order, unless the customer has elected to use their own nominated courier or collection agent.

If an order is damaged during transit, arrives incomplete, or is not received within a reasonable period after dispatch, the customer must notify Nanodog as soon as reasonably possible. Nanodog will assist by providing shipment tracking information, proof of dispatch, and by liaising with the courier where appropriate to investigate the matter.

Where the courier has been appointed by Nanodog, Nanodog will work with the courier to resolve any verified loss or damage in accordance with applicable South African consumer protection legislation. Where the customer has appointed their own courier or transport provider, any claims relating to loss, theft or damage occurring after collection by that courier must be directed to the nominated courier.

In addition to any manufacturer's warranty that may apply to a product, consumers are afforded certain rights under the Consumer Protection Act, 68 of 2008 ("CPA"), including the implied warranty of quality provided for in section 56 of the CPA. Nothing contained in these Terms and Conditions is intended to limit or exclude any rights that cannot lawfully be excluded under South African law.

Most products sold by Nanodog include a manufacturer's carry-in warranty of 12 (twelve) months or such other period as specified by the manufacturer. The duration, scope, limitations and exclusions of any manufacturer's warranty are determined solely by the manufacturer.

Where a manufacturer's warranty applies, the customer agrees to comply with the manufacturer's warranty terms and conditions.

The following conditions apply to warranty claims:

  • Products must be returned to Nanodog's designated workshop or authorised service centre at the customer's cost unless otherwise required by applicable law.
  • Products should, where reasonably possible, be returned in their original packaging together with all supplied accessories.
  • Proof of purchase, such as the original tax invoice or receipt, must accompany all warranty claims.
  • Warranty assessments and processing are conducted through Nanodog's workshop or another authorised service facility nominated by Nanodog.
  • Where on-site warranty assistance is requested and is not included under the applicable manufacturer's warranty, Nanodog's standard call-out and labour rates will apply.
  • Warranty coverage does not extend to software configuration, software installation, data recovery, virus removal, operating system issues, or user configuration unless expressly included with the product or service purchased.
  • Non-warranty repairs, labour, diagnostics, software services and data recovery will be charged at Nanodog's prevailing service rates. Payment in full is required before repaired goods may be collected or returned.

A warranty does not cover defects or failures resulting from, including but not limited to:

  • accidental damage;
  • misuse, abuse or neglect;
  • improper installation or operation;
  • liquid damage;
  • power surges or lightning damage where no surge protection was used;
  • unauthorised repairs or modifications;
  • use outside the manufacturer's specifications;
  • normal wear and tear; or
  • any other cause not attributable to a manufacturing defect.

Where physical damage, misuse or any other warranty exclusion is identified, the manufacturer's warranty may be declined in whole or in part, depending on the manufacturer's warranty policy.

Where a product is found to be defective due to a manufacturing fault and qualifies under the CPA or the applicable manufacturer's warranty, Nanodog may, at its election where permitted by law, or as required by the CPA, facilitate the repair, replacement or refund of the product in accordance with applicable legislation and the manufacturer's warranty procedures.

Nanodog is an authorised reseller of products manufactured by third parties and does not manufacture the products it sells. Manufacturer warranties remain the responsibility of the respective manufacturers. As a service to its customers, Nanodog will ordinarily facilitate warranty claims with manufacturers, distributors or authorised repair centres. However, Nanodog reserves the right, where appropriate, to refer customers directly to the relevant manufacturer, distributor or authorised service centre.

Nanodog cannot guarantee the future availability of spare parts, replacement components or accessories for any product. The availability of such items is determined solely by the relevant manufacturer, distributor or supplier and remains outside Nanodog's control.

Unless otherwise required by law, Nanodog shall not be liable for any loss of data stored on products submitted for warranty assessment or repair. Customers are solely responsible for ensuring that all data has been fully backed up before submitting any product for service or repair.

All devices submitted to Nanodog for inspection, diagnosis, repair or servicing are accepted subject to the following terms and conditions.

Nanodog will exercise reasonable care in the handling, storage and repair of all customer devices while they are in its possession. However, customers are strongly encouraged to maintain appropriate insurance cover for their devices, as Nanodog's liability shall, to the fullest extent permitted by law, be limited to loss or damage caused by Nanodog's negligence or wilful misconduct.

Customers are responsible for backing up all data before submitting any device for repair. Nanodog accepts no responsibility for the loss, corruption or recovery of any data, software, applications, passwords or settings during the diagnostic or repair process.

The original Job Card or satisfactory proof of ownership must be presented when collecting a device. Nanodog reserves the right to request additional identification before releasing any item where ownership cannot reasonably be established.

Nanodog's standard labour and diagnostic rates may apply to any inspection, diagnosis, repair or software service unless otherwise agreed in writing.

No repaired device will be released until the full invoiced amount has been paid, unless alternative payment arrangements have been agreed to in writing by Nanodog.

Upon completion of a repair, Nanodog will notify the customer using the contact details provided on the job card. It is the customer's responsibility to ensure that these contact details remain accurate and up to date.

Devices not collected within fourteen (14) days after notification of completion may be transferred to long-term storage unless alternative arrangements have been agreed to in writing. A storage fee of R115.00 (including VAT) per day may be charged from the date the device is transferred into storage.

Once a device has been transferred to long-term storage, the repair order may be administratively closed by Nanodog. This administrative closure does not affect the customer's ownership of the device or any outstanding payment obligations.

If a device remains uncollected for more than ninety (90) days after written notice has been given to the customer, and all reasonable attempts to contact the customer have been unsuccessful, Nanodog reserves the right, to the extent permitted by applicable law, to recover reasonable unpaid repair, storage and administrative costs. This may include exercising any rights available under South African law, including a repairer's lien or disposing of the uncollected goods after giving any notices required by law. Any surplus remaining after the lawful recovery of such costs shall be dealt with in accordance with applicable legal requirements.

It remains the customer's responsibility to notify Nanodog of any changes to their contact details and to make reasonable enquiries regarding the status of their repair where necessary.

Change of Mind Returns

Subject to applicable South African law, Nanodog may, at its discretion, accept the return of products where a customer has changed their mind, provided that the return is requested within seven (7) days of the original purchase date.

Products accepted for a change-of-mind return must:

  • be in substantially the same condition as supplied;
  • be unused and free from damage;
  • include all original accessories, manuals and documentation;
  • be returned, where reasonably possible, in their original packaging; and
  • be accompanied by the original proof of purchase.

Where Nanodog accepts a change-of-mind return, Nanodog may, at its discretion and to the extent permitted by law:

  • issue an EFT refund
  • issue a store credit; or
  • exchange the product for another product of equal or greater value (subject to payment of any price difference).

Nanodog reserves the right to charge a reasonable handling or restocking fee, of up to 15% of the purchase price where permitted by the Consumer Protection Act and applicable regulations, particularly where goods are returned without any legal obligation requiring Nanodog to accept the return.

Software, digital licences, activation codes and similar products may only be returned if the packaging remains unopened, the licence has not been activated, and the product has not been used.

Products That Cannot Be Returned for Change of Mind

Unless otherwise required by law, the following items are not eligible for change-of-mind returns:

  • labour, installation, delivery charges and completed services;
  • software that has been opened, activated or registered;
  • digital products, activation keys or downloadable software once supplied;
  • microphones, earbuds, in-ear headphones, harmonicas and other hygiene-sensitive products where opened;
  • consumable items including batteries, ink cartridges and similar products;
  • products that have been engraved, customised, personalised or specially manufactured;
  • products specially ordered or procured at the customer's request;
  • lay-by purchases, subject to the Consumer Protection Act;
  • any other products specifically identified as non-returnable before purchase where permitted by law.

Deposits paid on special-order or customised products may be retained by Nanodog to the extent permitted by applicable law where the customer cancels the order after Nanodog has incurred costs or commenced procurement.

Faulty Products

Products returned because they are defective, unsafe or fail to meet the requirements of the Consumer Protection Act will be handled in accordance with the Consumer Protection Act, 68 of 2008, together with Nanodog's Warranty Policy where applicable. Nothing contained in this Returns Policy limits or excludes any rights afforded to consumers under South African law.

Inspection of Returned Products

All returned products are subject to inspection before a refund, replacement, repair or exchange is approved. This inspection is conducted to verify the reported fault, assess the condition of the product and determine whether the return qualifies under the Consumer Protection Act, the applicable manufacturer's warranty or this Returns Policy.

Inspection periods will vary depending on the nature of the product, the complexity of the fault and whether the product must be assessed by the manufacturer or an authorised service centre. While Nanodog aims to complete inspections as quickly as reasonably possible, inspection may take longer than twenty-four (24) hours where specialist testing or manufacturer assessment is required.

Nanodog makes every reasonable effort to ensure that the information, product descriptions, specifications, pricing and other content published on this Website are accurate and kept up to date. However, despite reasonable care, errors, omissions or inaccuracies may occasionally occur.

To the fullest extent permitted by applicable law, Nanodog does not warrant that the information contained on this Website will at all times be complete, accurate, current or free from errors. Product images, descriptions, specifications and availability are provided for general information purposes only and may differ from the actual products supplied.

Nanodog reserves the right, at any time and without prior notice, to modify, update, discontinue or remove any product, service, feature, pricing, specification or other content displayed on this Website. Such changes shall not affect orders that have already been accepted by Nanodog, except where correction is required due to an obvious pricing, typographical or technical error, as permitted by applicable law.

The opinions, recommendations, technical information and other content published on this Website are provided for general informational purposes only and should not be regarded as professional, technical or specialist advice. Customers remain responsible for determining the suitability of any product for their particular requirements.

Nothing contained on this Website limits or excludes any rights or remedies afforded to consumers under the Consumer Protection Act, 68 of 2008, the Electronic Communications and Transactions Act, 25 of 2002, or any other applicable South African legislation.


Nanodog makes every reasonable effort to ensure that all prices displayed on its website, quotations and other marketing material are accurate. However, despite reasonable care, pricing, typographical or system errors may occasionally occur.

All prices displayed on the Nanodog website are quoted in South African Rand (ZAR) and are inclusive of Value-Added Tax (VAT), unless expressly stated otherwise.

Nanodog reserves the right to amend product pricing at any time prior to accepting an order. Where a pricing error is discovered before an order has been accepted or fulfilled, Nanodog reserves the right to cancel the order and notify the customer of the correct price. Should the customer no longer wish to proceed with the purchase, any payment already received will be refunded in full.

Accepted quotations remain valid only for the period stated on the quotation. Unless otherwise specified, quotations are valid for seven (7) calendar days from the date of issue.

Payment must be received in full and cleared before goods are released or services are rendered, unless the customer has an approved credit facility or other written payment arrangement with Nanodog.

Where payment is made by Electronic Funds Transfer (EFT), goods will only be released once the funds have irrevocably cleared and are reflected in Nanodog's nominated bank account.

Nanodog reserves the right to refuse or delay the release of goods where payment verification is required or where fraudulent or suspicious transactions are reasonably suspected.

The following payment methods are accepted:

  • Electronic Funds Transfer (EFT)
  • Credit and Debit Cards
  • Approved Monthly Debit Orders for eligible subscription or cloud services
  • Any other payment methods made available by Nanodog from time to time

Customers are responsible for ensuring that all payment information supplied is accurate and that they are authorised to use the selected payment method.

Ownership of all goods shall remain vested in Nanodog until the full purchase price and any other amounts due have been paid in full. Risk in the goods passes to the customer in accordance with the Shipping & Delivery provisions contained in these Terms and Conditions.

Nothing in this section limits any rights afforded to consumers under the Consumer Protection Act, 68 of 2008, the Electronic Communications and Transactions Act, 25 of 2002, or any other applicable South African legislation.

Deposit Requirement

A minimum deposit of twenty-five percent (25%) of the total purchase price is required to initiate a lay-by agreement unless otherwise agreed in writing by Nanodog.

Payment Period

The outstanding balance must be paid in full within four (4) months from the date of the initial deposit, unless a different period has been agreed to in writing.

Should the customer fail to complete payment within the agreed lay-by period, and no alternative arrangement has been approved by Nanodog in writing, Nanodog reserves the right to cancel the lay-by agreement in accordance with the Consumer Protection Act, 68 of 2008.

Ownership and Collection

Ownership of the goods shall remain vested in Nanodog until the purchase price has been paid in full and all cleared funds have been received.

Goods will only be released once full payment has been received and reflected in Nanodog's nominated bank account.

Price Protection

The purchase price of the lay-by item is fixed at the time the lay-by agreement is concluded, provided the customer completes payment within the agreed lay-by period.

Cancellation by the Customer

The customer may cancel a lay-by agreement at any time before taking delivery of the goods.

Where a lay-by agreement is cancelled by the customer, Nanodog may deduct a reasonable cancellation fee as permitted by the Consumer Protection Act and its Regulations. The balance of any payments received will be credited to the customer.

Where the lay-by relates to a specially ordered, customised or personalised product, Nanodog may recover any reasonable costs actually incurred as a result of the cancellation, to the extent permitted by applicable law.

Special Orders and Clearance Items

Products specially ordered, customised or procured specifically at the customer's request, as well as clearance or end-of-line products, may be subject to additional cancellation restrictions or reasonable cancellation charges where permitted by applicable law. Such conditions will be disclosed to the customer before the lay-by agreement is concluded.

Failure to Complete the Lay-By

If the customer fails to complete payment within the agreed lay-by period and does not make alternative arrangements acceptable to Nanodog, Nanodog may cancel the lay-by agreement and recover any reasonable cancellation charges permitted by law before refunding any remaining balance to the customer.

Refunds

Any refunds arising from the cancellation of a lay-by agreement will be processed via EFT, unless otherwise agreed between Nanodog and the customer.

Nothing contained in this Lay-By Policy limits or excludes any rights afforded to consumers under the Consumer Protection Act, 68 of 2008.

The following terms apply to all approved Nanodog credit account holders.

Nanodog reserves the right to approve, decline, suspend, reduce or withdraw any credit facility at its sole discretion and in accordance with applicable South African legislation.

No further goods or services will be supplied on credit where the customer's approved credit limit has been reached or exceeded, unless otherwise authorised in writing by Nanodog.

Unless otherwise agreed in writing, all invoices are payable in full on or before the last business day of the month in which the invoice is issued.

Any amount not paid by the due date shall constitute an overdue account. Nanodog reserves the right to charge interest on overdue amounts at a rate of 2% per month, calculated monthly in arrears, or at the maximum rate permitted by applicable South African law, whichever is lower.

Nanodog reserves the right to suspend or place a credit account on hold where any amount remains outstanding beyond its due date. No further credit purchases will be permitted until the overdue balance, together with any applicable interest, has been paid in full or alternative arrangements have been agreed to in writing.

Should Nanodog instruct attorneys, collection agents or other authorised third parties to recover any outstanding amounts, the customer shall be liable for all reasonable legal and collection costs recoverable in accordance with applicable South African legislation.

Where goods are supplied pursuant to an insurance claim, insurance replacement order or similar arrangement, the customer remains responsible for payment of the purchase price should the insurer decline, delay or fail to settle the account for any reason, unless Nanodog has expressly agreed in writing to look solely to the insurer for payment.

Nanodog reserves the right to allocate any payments received to outstanding invoices, interest, legal costs, collection charges or other amounts owing in such order as Nanodog reasonably determines, unless otherwise required by law.

Ownership of all goods supplied on credit shall remain vested in Nanodog until the purchase price and all other amounts owing in respect of the transaction have been paid in full, to the extent permitted by applicable law.

Nothing contained in this section limits any rights or obligations arising under the National Credit Act, 34 of 2005, where applicable, or any other applicable South African legislation.

The following terms apply to all recurring service agreements, managed services, subscription services, cloud services and maintenance contracts entered into with Nanodog.

Unless otherwise agreed in writing, either party may terminate a service agreement by giving the other party not less than sixty (60) calendar days' prior written notice.

Termination of a service agreement shall not relieve either party of any obligations, fees or liabilities that accrued prior to the effective date of termination, including payment for services already rendered or commitments entered into on the customer's behalf.

Any amendment, variation or waiver of a service agreement shall only be valid if reduced to writing and signed or otherwise expressly agreed to by both parties.

Where a service is subject to a fixed-term commitment, annual subscription, minimum contract period or renewal cycle imposed by the manufacturer, software vendor or service provider (including, but not limited to, Microsoft, Adobe or similar subscription services), the customer acknowledges that Nanodog is bound by such commitment.

Accordingly, where Nanodog has committed to such services on behalf of the customer, the customer may only terminate or amend the service in accordance with the applicable vendor's cancellation and renewal terms. Unless otherwise advised in writing, requests to cancel or amend such services must be received by Nanodog at least sixty (60) days prior to the applicable renewal date to allow sufficient time for processing before the vendor's renewal takes effect.

Should the customer fail to provide notice within the required period, or where the underlying vendor has already renewed the subscription or incurred charges on the customer's behalf, the customer shall remain liable for all charges payable by Nanodog to the vendor for the applicable commitment period, to the extent permitted by applicable South African law.

Nothing contained in this section limits any rights afforded to consumers under the Consumer Protection Act, 68 of 2008, or any other applicable South African legislation where such legislation applies.


To the fullest extent permitted by applicable South African law, Nanodog shall not be liable for any indirect, incidental, special, punitive or consequential loss or damage, including but not limited to loss of profits, loss of business, loss of goodwill, loss of data or business interruption, arising out of or in connection with the use of this Website, the purchase of products or services, or any information made available by Nanodog.

Nanodog shall not be liable for any loss or damage arising from:

  • reliance on information, product descriptions or other content published on this Website;
  • the transmission or receipt of emails or other electronic communications;
  • temporary interruption, suspension or unavailability of the Website or any online services;
  • delays, interruptions or failures caused by telecommunications providers, internet service providers, payment gateways, hosting providers or other third-party service providers;
  • computer viruses, malware, cyber-attacks or other harmful code, provided Nanodog has taken reasonable steps to protect its systems;
  • the customer's misuse of any products or services;
  • the customer's failure to follow manufacturer instructions, product documentation or reasonable usage guidelines; or
  • any breach of these Terms and Conditions by the customer.

Nanodog makes no representation or warranty that the Website will be available at all times or that it will be free from errors, interruptions or security vulnerabilities, although Nanodog will use reasonable efforts to maintain the Website and its services.

Except where liability cannot lawfully be excluded or limited, Nanodog's total liability arising from any claim relating to the supply of goods or services shall not exceed the amount actually paid by the customer for the relevant goods or services giving rise to the claim.

Nothing contained in these Terms and Conditions excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited under the Consumer Protection Act, 68 of 2008, or any other applicable South African legislation.

These Terms and Conditions constitute the entire agreement between Nanodog and the customer relating to the purchase and supply of goods and services and supersede all prior discussions, negotiations, representations, proposals, understandings and agreements, whether oral or written, relating to the same subject matter, except where expressly incorporated into a written agreement signed by both parties.
